Acceptance of terms

These terms and conditions govern all supply of goods and services ("products") by Maddox Photography NZ ("Maddox Photography NZ", "we, "us") to you, the purchaser of goods and services from us, including your use of the website at maddoxphotographynz.co.nz ("the website"). They are effective from 1st of April and will replace all earlier Maddox Photography NZ terms of trade and any conditions contained in any document used by you and purporting to have contractual effect.

We reserve the right to change these terms of trade by notice to you. Notice may be given by posting the revised terms and conditions on our website.

Workshop Cancellations


Cancellation by Client:


  • If you need to cancel your participation, you must notify the organiser as soon as possible.
  • Cancellations made more than 24 hours before the scheduled workshop will receive a full refund, minus a $120 processing fee.
  • Cancellations made within 24 hours of the scheduled workshop will receive a full refund, minus a $200 processing fee.
  • If you fail to attend the workshop without prior cancellation, the full workshop fee will be retained.

About Our Tours
Our Japan tours are designed to provide an organised and guided travel experience in Japan. Depending on the tour, arrangements may include accommodation, transportation, sightseeing, activities, meals, guides, tour leaders and other services as specifically stated in your itinerary.

Each tour is different. Your confirmed itinerary and booking documentation will specify what is included in your particular tour.

Unless expressly stated as included, items such as international flights, travel insurance, airport transfers, meals, drinks, personal expenses, optional activities, baggage fees, visas and other incidental expenses are not included.

Making a Booking
A booking is considered confirmed when:

  1. you have completed the required booking information;
  2. we have accepted your booking; and
  3. the required deposit or full payment has been received.
Payment of the required deposit constitutes your acceptance of these Terms.

A booking confirmation or invoice will be provided once your booking has been accepted.

We reserve the right to decline a booking where reasonable grounds exist, including where a tour is full, the passenger does not meet applicable age or participation requirements, or we are unable to safely or reasonably accommodate the passenger.

Deposits and Payments
A deposit of NZ $3000 per person is required to secure your place on the tour unless otherwise stated in writing.

Your booking is not guaranteed until the required deposit has been received.

The deposit may be non-refundable because we may immediately use part of it to secure accommodation, transportation, activities, guides and other arrangements with third-party suppliers.

Where a booking is made within 90 days of departure, full payment may be required at the time of booking.

Final Payment
The balance of your tour price is due no later than 90 before departure, unless a different payment date is stated on your invoice or booking confirmation.

If payment is not received by the due date, we may treat the booking as cancelled by you and apply the applicable cancellation charges.

We will make reasonable efforts to contact you before cancelling a booking for non-payment.

Payment Fees
Any bank, credit-card, currency-conversion or payment-provider fees charged in connection with your payment may be payable by you where advised at the time of payment.

Prices
All prices are quoted in New Zealand dollars (NZD) unless otherwise stated.

Prices are based on the costs and exchange rates applicable at the time the tour is priced.

Unless otherwise stated, our advertised tour price includes GST where applicable.

Your confirmed booking price will be shown on your invoice or booking confirmation.

We reserve the right to correct genuine pricing errors or omissions made in advertising, quotations or booking documentation.

What Is Included
The inclusions for your tour will be set out in your itinerary and booking confirmation.

Depending on the particular tour, inclusions may include:

  • accommodation;
  • breakfasts and/or other meals;
  • rail and other domestic transportation;
  • private or shared transfers;
  • guided sightseeing;
  • entrance fees;
  • organised activities;
  • local guides;
  • tour leader services;
  • selected experiences; and
  • other services specifically identified as included.
If an item is not specifically stated as included, you should assume it is not included.

What Is Not Included
Unless specifically stated otherwise, the following are generally excluded:

  • international flights to and from Japan;
  • travel insurance;
  • passports and visas;
  • airport taxes or charges not specifically included;
  • personal shopping and expenses;
  • alcoholic and additional beverages;
  • meals not specified as included;
  • optional activities;
  • excess baggage and baggage fees;
  • laundry;
  • telephone and internet charges;
  • room service;
  • medical or pharmaceutical expenses;
  • expenses arising from illness, injury or personal circumstances;
  • costs resulting from missed transport;
  • costs resulting from a passenger's failure to follow the itinerary or instructions; and
  • any other item not expressly stated as included.

Accommodation
Accommodation will be provided as described in your confirmed itinerary.

Room types may include twin-share, double, single or other arrangements depending on the tour.

Where a tour is priced on a twin-share basis, a single supplement may apply if you require or are allocated a private room.

Accommodation standards, room sizes, facilities and services in Japan can differ from those commonly experienced in New Zealand.

Room requests, including specific beds, floors, views or adjoining rooms, are requests only unless expressly confirmed in writing.

Where accommodation becomes unavailable for reasons outside our reasonable control, we may substitute accommodation of a similar standard and location where reasonably possible.

Single Travellers
Single travellers are welcome unless a particular tour states otherwise.

Where the advertised tour price is based on shared accommodation, a single supplement may apply.

The applicable single supplement will be advised at the time of booking.

Where a shared-room arrangement is specifically offered, we cannot guarantee the personality, habits or compatibility of another traveller.

Transportation and Rail Travel
Japan has an extensive and generally reliable public transportation network. Our tours may use trains, buses, coaches, subways, ferries, taxis and other forms of transportation.

Rail services and public transportation may involve:

  • walking between stations and platforms;
  • stairs and escalators;
  • crowds;
  • standing;
  • carrying or managing your own luggage;
  • changes of trains;
  • short connection times; and
  • navigating stations independently.
Passengers are responsible for being ready at the designated meeting point at the stated time.

If a passenger misses a train, transfer, meeting point or other scheduled service because they are late or do not follow the instructions provided, any resulting costs may be the passenger's responsibility.

Luggage
Passengers are responsible for their luggage and personal belongings throughout the tour unless those items are expressly placed into our custody.

Japan's trains and accommodation often provide limited luggage space.

Your itinerary may include luggage-forwarding services or luggage restrictions. Where applicable, these will be explained before departure.

Passengers must comply with any baggage size, weight or quantity restrictions imposed by airlines, rail operators, accommodation providers or other suppliers.

We are not responsible for loss, theft, damage or delay to personal belongings except to the extent required by law.

We strongly recommend that valuable items, passports, money, medication and important documents are carried securely and kept with you.

Travel Documents and Entry Requirements
You are responsible for ensuring that you hold:

  • a valid passport;
  • any visa or entry permission required for Japan;
  • any required onward or return travel documentation;
  • sufficient validity remaining on your passport;
  • any required vaccination or health documentation; and
  • any other documentation required by the relevant authorities.
Entry requirements can change.

You should check current requirements with the relevant Japanese authorities and your airline before travelling.

We are not responsible for losses arising because you are refused entry, denied boarding or unable to travel because your travel documents or immigration requirements are not in order.

Travel Insurance
Comprehensive travel insurance is strongly recommended and may be required as a condition of participating in your tour.

Your policy should, where appropriate, cover:

  • cancellation and amendment costs;
  • medical treatment;
  • emergency evacuation;
  • repatriation;
  • lost or stolen luggage;
  • travel delays;
  • missed connections;
  • personal liability; and
  • other risks associated with international travel.
Travel insurance should be arranged as soon as you pay your deposit because cancellation or other financial losses may occur before your departure.

We do not provide insurance unless expressly stated in your booking.

Cancellation by You
If you need to cancel your booking, you must notify us in writing by email.

Cancellation takes effect on the date we receive your written cancellation during our normal business hours.

Cancellation charges are based on the date we receive your cancellation notice, not the date you decide to cancel.

Unless different cancellation terms are stated for your particular tour, the following proposed schedule applies:

No-show / failure to travel 100%

Any non-refundable third-party costs, including flights, accommodation, rail tickets, activities, permits, event tickets or other supplier charges, may also be deducted from any amount otherwise refundable.

The cancellation schedule may be different for specific tours or bookings where suppliers impose stricter cancellation conditions. Any such special conditions will be disclosed before or at the time of booking.

Cancellation After Departure
No refund is generally available for unused portions of a tour once the tour has commenced, including where you:

  • arrive late;
  • leave the tour early;
  • miss a scheduled activity;
  • voluntarily choose not to participate;
  • miss transportation;
  • are unable to participate because of personal circumstances; or
  • are removed from the tour because of your conduct.
You should contact your travel insurer regarding any potentially insured loss.

Changes Requested by You
We will make reasonable efforts to accommodate requests to change:

  • travel dates;
  • accommodation;
  • room arrangements;
  • transportation;
  • activities;
  • passenger numbers; or
  • other itinerary components.
Changes are subject to availability and supplier conditions.

A change may result in:

  • additional supplier charges;
  • fare differences;
  • cancellation fees;
  • accommodation penalties;
  • administrative fees; or
  • the loss of services that cannot be changed or refunded.
A requested change may also be treated as a cancellation and rebooking.

Transfer of a Booking
If you are unable to travel, you may request that your booking be transferred to another person.

Any transfer is subject to:

  • our approval;
  • availability;
  • supplier approval;
  • the new passenger meeting all tour requirements;
  • payment of any applicable supplier or administration charges; and
  • the new passenger agreeing to these Terms.
Transfers are not guaranteed and may not be possible for certain flights, accommodation, rail bookings, event tickets or other services.

Changes to the Itinerary by Us
We carefully plan our itineraries, but travel involves circumstances outside our control.

We reserve the right to make reasonable changes to an itinerary where necessary, including changes to:

  • accommodation;
  • transportation;
  • sightseeing;
  • restaurants;
  • activities;
  • guides;
  • route;
  • sequence of destinations; or
  • scheduled times.
Reasons may include weather, transport disruption, supplier changes, operationalrequirements, safety concerns, government requirements, closures, events or other circumstances beyond our reasonable control.

Where reasonably possible, we will provide an alternative of a similar nature and standard.

Minor itinerary changes do not ordinarily entitle you to cancel your booking without applicable cancellation charges.

Where a significant change is required before departure, we will communicate the change and any rights or options available to you under applicable law.

Minimum Numbers
Some tours may require a minimum number of passengers to operate.

Where a minimum number applies, this will be disclosed before booking where reasonably practicable.

If we need to cancel a tour because the minimum number of passengers has not been reached, we will notify affected passengers as soon as reasonably practicable and provide the applicable options, which may include:

  • transferring to another departure;
  • accepting a revised itinerary or price; or
  • receiving a refund of amounts paid for services that we cancel.
Our obligations will be subject to applicable New Zealand law.

Cancellations by Us
We reserve the right to cancel a tour before departure where reasonably necessary, including because of:

  • insufficient passenger numbers;
  • supplier failure;
  • significant transportation disruption;
  • government restrictions;
  • natural disasters;
  • safety concerns;
  • war, terrorism or civil unrest;
  • significant weather events;
  • pandemics or public-health restrictions; or
  • other circumstances beyond our reasonable control.
If we cancel a tour for reasons within our control and applicable law requires a refund, we will provide the applicable refund.

Where cancellation results from circumstances outside our reasonable control, our obligations will be determined by these Terms, the terms of the relevant suppliers and applicable New Zealand law.

We will make reasonable efforts to assist passengers in identifying alternative arrangements where appropriate, but additional costs may apply.

Force Majeure
We are not responsible for delays, cancellations, changes, losses or additional expenses caused by events beyond our reasonable control ("Force Majeure Events").

These may include, without limitation:

  • earthquakes;
  • tsunamis;
  • typhoons;
  • extreme weather;
  • volcanic activity;
  • natural disasters;
  • pandemics or epidemics;
  • government action;
  • border closures;
  • changes to immigration requirements;
  • war;
  • terrorism;
  • civil unrest;
  • strikes;
  • industrial disputes;
  • transport failures;
  • power outages;
  • supplier insolvency or failure;
  • infrastructure failure; or
  • other unforeseeable or unavoidable events.
Where a Force Majeure Event affects your tour, we will act reasonably and in good faith to minimise disruption and will communicate available alternatives where practicable.

You remain responsible for costs not recoverable from us or our suppliers, which is why comprehensive travel insurance is strongly recommended.

Health, Fitness and Accessibility
Japan tours can involve considerable walking, stairs, standing, public transportation, uneven surfaces and periods of extended activity.

You must ensure that you are physically capable of participating in the activities included in your chosen tour.

You must advise us before booking of any condition, disability, mobility requirement, dietary requirement or other circumstance that may reasonably affect your ability to participate.

We will make reasonable efforts to accommodate disclosed requirements where practicable.

However, not all locations, accommodation, transportation or activities in Japan are accessible to all travellers.

Some attractions and historic sites may have stairs, uneven surfaces or limited accessibility.

If you have any concerns about your ability to participate, please discuss them with us before booking.

Medical Conditions and Medication
You are responsible for managing your own medical needs while travelling.

You should carry sufficient medication for the entire journey and keep medication in its original packaging where appropriate.

You should also carry copies of relevant prescriptions and medical information where appropriate.

We are not a medical provider and our tour leaders are not responsible for providing medical treatment.

If a medical emergency occurs, we may assist in contacting emergency services or obtaining medical assistance, but any medical, evacuation or related expenses remain your responsibility unless covered by applicable law or your travel insurance.

Dietary Requirements and Allergies
We will make reasonable efforts to communicate dietary requirements to relevant suppliers where these are disclosed to us before travel.

However, we cannot guarantee that every restaurant, hotel, activity provider or food outlet will be able to accommodate every dietary requirement or allergy.

Japan's food culture includes ingredients that may not always be obvious to visitors.

If you have a serious allergy, you remain responsible for taking reasonable precautions and communicating your requirements directly when necessary.

Passengers with severe allergies should carry appropriate medication and emergency treatment, such as an adrenaline auto-injector where prescribed.

Passenger Responsibilities
During the tour you agree to:

  • follow reasonable instructions given by our tour leaders and guides;
  • arrive at designated meeting points on time;
  • respect local laws and customs;
  • behave respectfully towards other passengers, staff and members of the public;
  • respect accommodation rules;
  • take reasonable care of property;
  • comply with transportation rules;
  • maintain appropriate personal conduct; and
  • ensure your behaviour does not adversely affect the safety, enjoyment or wellbeing of other passengers.
Unacceptable Behaviour
We reserve the right to remove a passenger from a tour where their behaviour:

  • is threatening, abusive or violent;
  • endangers themselves or others;
  • seriously disrupts the tour;
  • damages property;
  • involves illegal activity;
  • involves harassment or discrimination;
  • involves excessive intoxication;
  • repeatedly disregards reasonable instructions; or
  • materially affects the safety or enjoyment of other passengers.
Where a passenger is removed from a tour because of their behaviour, they may beresponsible for all additional costs associated with leaving the tour, including transportation and accommodation.

No refund will ordinarily be provided for unused tour services in such circumstances.

Alcohol and Drugs
Passengers must comply with Japanese law regarding alcohol, controlled substances and prohibited drugs.

Illegal drug use or possession will not be tolerated.

We reserve the right to take appropriate action, including removing a passenger from the tour, where their conduct creates a safety or legal concern.

Children and Age Requirements
Minimum and maximum age requirements may apply to particular tours or activities.

Where applicable, these requirements will be stated in the tour information.

Passengers under 18 must be accompanied by a parent, legal guardian or other person authorised to travel with them unless we have expressly agreed otherwise in writing.

Parents and guardians remain responsible for supervising children throughout the tour.

Photography, Video and Marketing
During tours, photographs or video may be taken by us, our guides or other participants.

By participating in a tour, you acknowledge that you may appear incidentally in photographs or video taken during group activities.

Where we intend to use identifiable images of you for promotional purposes, we will seek any consent required by applicable law.

If you do not wish to appear in promotional material, please notify us.

Third-Party Suppliers
Many components of our tours are provided by independent third parties, including:

  • airlines;
  • rail operators;
  • hotels;
  • restaurants;
  • activity providers;
  • transport companies;
  • local guides; and
  • attraction operators.
Those suppliers may have their own terms and conditions.

Where applicable, supplier terms may affect cancellation, refunds, baggage, seating, accommodation, activities and other aspects of your booking.

We will pass on relevant supplier requirements to you where reasonably practicable.

Our Responsibility for Third-Party Services
We carefully select suppliers and make reasonable efforts to use reputable providers.

However, we do not control the day-to-day operation of independent suppliers.

Subject to your rights under applicable New Zealand law, we are not responsible for losses caused solely by the acts or omissions of an independent supplier where we have exercised reasonable care in selecting and arranging that supplier.

Nothing in these Terms is intended to exclude, restrict or modify any right or remedy that cannot lawfully be excluded, restricted or modified.

Flights
Unless specifically stated as included, international flights are not included in the tour price.

If we arrange flights on your behalf, the applicable airline's conditions of carriage will apply.

Airlines may make changes to:

  • flight times;
  • aircraft;
  • routes;
  • baggage allowances;
  • seating;
  • connections; or
  • other flight arrangements.
Flight schedules are outside our control.

Passengers are responsible for complying with airline check-in requirements and baggage restrictions.

Missed Connections and Delays
You are responsible for allowing sufficient time for international flights, domestic flights, trains and other connections.

If you miss a connection due to your own lateness, failure to follow instructions or other personal circumstances, any resulting costs may be your responsibility.

Where a delay is caused by circumstances outside your control, we will provide reasonable assistance where practicable but cannot guarantee that replacement transportation or accommodation will be provided at no additional cost.

Currency and Personal Spending
Japan uses the Japanese Yen (JPY).

Passengers should ensure they have access to sufficient funds for personal expenses.

Exchange rates fluctuate and we are not responsible for losses caused by currency movements.

Credit-card acceptance can vary, particularly at smaller businesses.

Free Time
Some itineraries include periods of free time.

During free time, passengers are responsible for their own activities unless an activity has been specifically organised and included by us.

We are not responsible for incidents arising from activities undertaken independently during free time except to the extent required by law.

No-Shows
If you fail to attend the tour, accommodation, transportation, activity or other service at the required time without notifying us, this will generally be treated as a no-show.

No refund will normally be available for no-shows.

Unused Services
No refund is generally available for services that you choose not to use or are unable to use after the tour has commenced.

This includes, without limitation:

  • unused accommodation;
  • missed meals;
  • unused transport;
  • missed activities;
  • unused sightseeing;
  • late arrival;
  • early departure; or
  • voluntarily leaving the tour.
Where a refund is available from a third-party supplier, we will make reasonable effortsto recover that amount on your behalf.

Complaints
We want you to have an enjoyable experience and encourage you to raise any issue as soon as it occurs.

If you experience a problem during your tour, please notify your tour leader or our local representative immediately so that we have a reasonable opportunity to investigate and, where possible, rectify the issue.

If the matter cannot be resolved during the tour, please submit your complaint to us in writing within 30 days of completing the tour.

Your complaint should include:

  • your name;
  • booking reference;
  • tour dates;
  • details of the issue;
  • steps already taken to resolve it; and
  • the outcome you are seeking.
We will review complaints fairly and respond within a reasonable period.

Nothing in this clause limits any rights you may have under New Zealand law.

Consumer Guarantees Act and New Zealand Law
These Terms are governed by the laws of New Zealand.

Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies available to consumers under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or any other applicable New Zealand legislation where those rights cannot lawfully be excluded.

Where you are acquiring services for business purposes and the law permits the parties to contract out of particular statutory protections, any such exclusion will only apply where expressly agreed in writing.

Limitation of Liability
To the maximum extent permitted by law, we will not be liable for loss, damage, delay, expense or inconvenience arising from circumstances beyond our reasonable control.

This may include losses arising from:

  • weather;
  • natural disasters;
  • transport disruption;
  • supplier failure;
  • government action;
  • strikes;
  • border restrictions;
  • illness;
  • personal injury not caused by our breach of duty;
  • lost or stolen property;
  • changes to public transportation;
  • missed connections; or
  • acts or omissions of independent suppliers.
Nothing in these Terms excludes liability that cannot legally be excluded.

Personal Belongings
You are responsible for your personal belongings throughout the tour.

We strongly recommend that you keep valuables, passports, cash, electronics and important documents secure.

If an item is lost or stolen, you should report the incident to the relevant hotel, transportation provider, police or other authority as appropriate and contact your travel insurer.

Privacy
We collect and use personal information necessary to provide your tour and associated travel services.

This may include information required for:

  • accommodation;
  • transportation;
  • activities;
  • emergency contacts;
  • dietary requirements;
  • passport or travel information;
  • insurance or other travel arrangements.
We may need to provide relevant information to suppliers and service providers in Japan and elsewhere for the purpose of delivering your booking.

We will handle personal information in accordance with our Privacy Policy and applicable New Zealand privacy law.

Website and Advertising Information
We take reasonable care to ensure that information published on our website, brochures and promotional material is accurate.

However, photographs and descriptions are intended as a general representation and may not exactly reflect the accommodation, facilities or experiences available at the time of travel.

Tour information may change due to supplier availability, seasonal conditions, operational requirements or other circumstances.

Your confirmed itinerary takes precedence over general promotional information.

Special Requests
We are happy to consider reasonable special requests.

Requests may include:

  • dietary requirements;
  • room preferences;
  • celebrations;
  • mobility requirements; or
  • other reasonable arrangements.
A request is not guaranteed unless we have expressly confirmed it in writing.

The fact that a request appears on a booking form or has been passed to a supplier does not necessarily mean that it has been confirmed.

Tour Leaders and Guides
Our tour leaders and guides are responsible for coordinating the tour and assisting passengers within the scope of their role.

They may make reasonable decisions concerning itinerary adjustments, timing, activities and passenger safety.

Passengers agree to follow reasonable directions given by tour leaders and guides.

Itinerary Timing
Tour itineraries provide an indication of planned activities and timings.

Actual timings may change because of transportation schedules, weather, traffic, crowds, attraction operating conditions and other circumstances.

We do not guarantee that every activity will operate at precisely the time shown in promotional material.

Japan-Specific Travel Considerations
Passengers should be aware that travelling in Japan can involve:

  • substantial walking;
  • stairs;
  • crowded train stations;
  • busy public transport;
  • early starts;
  • late finishes;
  • changing accommodation;
  • luggage handling;
  • limited room sizes;
  • sleeping on futons or traditional bedding on some tours;
  • Japanese-style bathrooms;
  • unfamiliar foods;
  • seasonal weather;
  • earthquakes and other natural events; and
  • cultural practices that may differ from those in New Zealand.
By booking, you acknowledge that these characteristics may form part of the travel experience.

Natural Disasters and Earthquakes
Japan is located in a seismically active region and may experience earthquakes, tsunami warnings, typhoons, volcanic activity and other natural events.

If such an event occurs, we may modify or suspend activities where we reasonably believe this is necessary for passenger safety.

Passengers must follow instructions issued by our representatives and Japanese authorities.

Any additional costs arising from such events may be subject to your travel insurance and the applicable supplier terms.

Tour Leader Discretion
For the safety and wellbeing of the group, our tour leader or authorised representative may make reasonable decisions regarding:

  • itinerary changes;
  • transportation;
  • activities;
  • accommodation;
  • passenger participation; and
  • emergency arrangements.
Their reasonable instructions must be followed.

Emergency Situations
In an emergency, we may take reasonable steps to protect your safety and wellbeing.

This may include arranging:

  • medical assistance;
  • alternative transportation;
  • accommodation;
  • changes to the itinerary;
  • evacuation; or
  • contact with emergency services.
You are responsible for any costs incurred on your behalf that are not otherwise coveredby us, a supplier or your insurance.

Changes to These Terms
We may update these Terms from time to time.

The Terms applicable to your booking will generally be those provided to you or made available at the time your booking is confirmed.

Changes made after booking will not retrospectively remove rights that you have already acquired under applicable law.

Entire Agreement
These Terms, together with your booking confirmation, itinerary, invoice and any specific written conditions applicable to your tour, form the agreement between you and Maddox Photography NZ concerning your booking.

Where there is an inconsistency, the specific terms provided for your particular tour will apply to the extent of that inconsistency.

Acceptance
By paying your deposit or full payment, you confirm that:

  • you have read and understood these Terms & Conditions;
  • you have had an opportunity to ask questions before booking;
  • the information you have provided to us is accurate;
  • you understand what is and is not included in your tour;
  • you understand the applicable cancellation conditions;
  • you understand the importance of obtaining travel insurance; and
  • you agree to be bound by these Terms.

Cancellation by Organiser:


  • The organiser reserve the right to cancel or reschedule the workshop due to unforeseen circumstances, including extreme weather conditions, safety concerns, or inadequate participant numbers.

Liability Limitation

Where you acquire or hold yourself out as acquiring goods or services from us for the purposes of a business, the provisions of the Consumer Guarantees Act 1993 will not apply. The conditions, warranties and guarantees set out in the Sale of Goods Act 1908 or otherwise implied by statute or common law will not apply and are excluded from these terms of trade.

We will always endeavour to have complete and accurate information on our website but to the greatest extent permissible by law we assume no responsibility for the completeness and current accuracy of the information provided on our website.

To the greatest extent permissible by law, we exclude all liability we may have to you for any claim except where we have acted in bad faith. This exclusion also applies for the benefit of every officer, employee, contractor, agent of us and anyone else we use to perform our duties or provide services under any agreement you have with us. None of the persons specified above is liable or has to pay you for anything else in connection with or resulting from anything any of us does or does not do, or delays in doing, whether or not it is contemplated or authorised by any agreement you have with us. This exclusion applies whatever you are claiming for and in whatever way liability might arise. This exclusion does not limit any inalienable rights you may have under the Consumer Guarantees Act 1993.

Our maximum liability to you (if any) shall be limited to the value of any faulty products or services supplied by us and we, our employees, contractors and agents, will not be liable to you for loss or damage of any kind however that loss or damage is caused or arises.


Applicable law and jurisdiction

Unless we otherwise agree in writing, this agreement contains all the terms of our relationship and continues to apply no matter where you are located at the time any goods or services are provided to you by us and irrespective of the location where you reside.

Use of our website, supply of products or services by us to you and any other matter arising from these Terms and Conditions are subject to the laws of New Zealand. The Courts of New Zealand shall have non-exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these terms of trade, or with the use of website or supply of any services.

Where you or any other person who you act for, or who you permit to act for you supplies incorrect information for the purchase of a product or service and we incur cost in any matter concerning that name then we may recover the costs incurred by us from you (including legal costs on a solicitor-client basis).

You agree to use our website, products and services in accordance with the applicable laws of the country or countries where your business or organisation is based.

Privacy policy and Confidentiality

Unless you opt to receive messages from us we will not contact you again in future. If you have opted to receive ongoing communications and at a later date you no longer wish to receive these communications you will be able to opt out of receiving this information by contacting us by email or by following the unsubscribe instructions at the bottom of emails sent to you.

Opting out of receiving the above mentioned messages will not prevent the sending of messages that specifically relate to your order(s).

We may use personal information that we collect about you to provide products and services to you and to administer orders and payments relating to your purchases from us.

If we fail to enforce any terms or to exercise our rights under these terms and conditions at any time, we have not waived those rights.

If any provision of these terms and conditions is held to be invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect and the parties shall adjust their respective rights and obligations in accordance with the spirit and intent of the parties as shown by these terms and conditions.

Unless any provision in this agreement expressly provides otherwise, these terms and conditions are not intended to confer a benefit on any person or class of person who is not a party to it.

We may deliver notices to you by sending them to an email address that you have notified to us.

To make a purchase from our online shop you must be 18 years of age or over.

Purchases from our online shop may only be made by persons who are acquiring goods or services for their own use or consumption, and you must not acquire goods from us via the website for resupply (whether in trade or otherwise).

If you are purchasing on behalf of another entity such as a company you warrant you have the authorisation to agree to these terms and conditions on behalf of the entity.

Availability and supply

All orders are subject to the availability of those products or services. If for any reason a Product is not available, we will endeavour to notify the non-availability on our online shop.

Delivery and delivery charges

Prices for goods and services stated on our website are exclusive of any applicable delivery charges.

We only deliver to New Zealand street addresses. The cost of delivery is as stated on our website and a total delivery cost will be provided in the order summary in your online shopping basket.

We will use all reasonable endeavours to ensure that orders for tangible goods will be dispatched promptly after an order has been placed.

Pricing

All prices are in New Zealand Dollars and are inclusive of any Goods and Services Tax ("GST") unless stated to be otherwise but are exclusive of delivery charges. All prices are correct when published. We reserve the right to alter prices at any time.

An invoice will be emailed to you at the email address you supply when you place your order. You are responsible for ensuring that your contact details are correct.

Shipping and delivery

Our physical workshops and tours do not have shipping costs applied to them at checkout.

Print and canvas orders will have a shipping cost applied to them at checkout. Orders will be shipped to you via courier. We will notify you with a tracking number once shipped.

Returns

1. Returns Eligibility

We want you to be happy with your purchase, but due to the nature of custom-made products like prints and canvases, we can only accept returns under specific conditions:

  • Damaged or Defective Products: If your print or canvas arrives damaged or defective, please contact us within 7 days of receipt. We will request photos of the damage and arrange a replacement or a full refund, depending on the situation.
  • Incorrect Item: If you received an item that is different from what you ordered, please reach out to us within 7 days. We will arrange to send you the correct item and cover any return shipping costs for the incorrect one.
  • Change of Mind: Unfortunately, we do not accept returns for change of mind due to the custom nature of our products. Please make sure to double-check your order before confirming your purchase.

2. Replacements


  • Once we receive the returned item, we will process your replacement photo or Canvas
  • Please allow 7-10 business days for the replacement to arrive.
